    The Crown Prosecution Service (CPS) prosecutes criminal cases that have been investigated by the police and other investigative organisations in England and Wales.

    Actually. You are wrong, it would be the CPS who would decide.

    Banning someone from a football stadium, is not something which has a judicial process included.

    I think we have gone through the fact that someone has to report an ‘offence’. There would have to be witnesses and other mechanisms to determine if an offence has been committed. The police can charge someone, but the CPS will decide if the grounds for a prosecution are met.

    Given the nature of the issue, then it would probably end up at the Crown Court if those charged, decided to plead not guilty.

    I think some degree of proportionality needs to be employed here. For sure if those involved can be clearly identified, then if they have not been involved in any previous incident then the club may decide that a stern written warning with a marker on their Season Ticket is a ‘balanced’ way forward, if they acknowledge their wrong doing.

    I guess another mechanism would be to only allow entry to the smoking area for people over a certain age and that they had to scan their cards to enter (although this all adds to the cost). So it would be like other areas of the ground where you pay a premium for access. Additionally CCTV cameras with an Audio element could be used. Finally the smoking area could be closed as a result of this activity which may make a lot of them think.
