You tend to find a replacement before jettisoning your only personal means of movement.

However, in JM's case - If his Gardening Leave has no actual date of closure, then finding a suitable position would be difficult.

Gardening leave only generally extends for the employees notice period (given he resigned in June, I would imagine that notice period has probably expired - it's unusual for it to be more than 3 months).

After someone leaves a place of work, it is possible to have people agree non-compete/restraint of trade agreements (usually for a fee). These absolutely have to have an end date or are deemed void for uncertainty and thus unenforceable. It also has to be drafted very specifically and not generally prevent the individual gaining other employment (other than in a specific narrow field of work).

If it's not a non-compete but a more straightforward confidentiality agreement then the rules are slightly different and it will depend on the specific way "Confidential Information" is drafted in that agreement (which typically excludes information which is already in the public domain - meaning he would not be in breach by commenting on things that are public knowledge).

All in all I suspect James is not saying anything because he is a man of integrity that loves the club rather than any specific legal obligation to do so.
