Parking at Forster Square Retail Park

    I think it depends on the situation.
    I got a 'ticket' for parking outside a designated area in a York University car park when I needed to be in a meeting, it was p!ssing with rain and there was nowhere else to park. My car wasn't causing an obstruction and I paid and displayed as required. A classic case of unnecessary jobsworthism.
    Another time I was half an hour over time in an otherwise empty car park. Another time was on a factory forecourt in an industrial estate on a Saturday afternoon when the factory was closed.
    All examples of blatant profiteering for no logical reason except to screw money out of people for doing nothing antisocial.

    yes the supreme court ruled that it was legal for private parking companies to charge, It was said the companies would never go to court fearing losing and as such you could just ignore and would go away, However rather than ignore it a motorist took it to court himself and lost,

    "A motorist who mounted legal proceedings against a private parking firm after he was slapped with an £85 ticket for overstaying at one of its car parks has today lost his case at the highest court in the UK. But while the ruling makes it harder to challenge tickets on the grounds of 'excessive' cost, don't despair – it's still possible to fight unfair tickets.

    It's been two-and-a-half years since Barry Beavis first received an £85 ticket from ParkingEye Ltd after he overstayed by 56 minutes at one of its 'two-hours for free' car parks in Chelmsford.

    Since then, the Essex father-of-two has taken his case to the County Court and the Court of Appeal to argue the charge wasn't proportionate to the loss incurred by the firm, especially as the car park offered limited free parking.

    After losing both times, the chip shop owner in July took his case to the Supreme Court – the highest court in the UK – which today decided against him, ruling the £85 charge was not "excessive" or "unfair". ( MSE NEWS )

    Why is it wrong to park on a closed factory forecourt in a largely deserted industrial estate on a Saturday? I appreciate that it is, strictly legally, trespass but can't see that anyone suffers or that it is morally reprehensible.
    Tapping someone gently on the arm is, strictly legally, an assault, but no one would pursue it because it would be disproportionate to the harm suffered. Parking in a deserted industrial estate outside opening hours seems to me to be the same - it's a victimless action.

    I understand the court case was in July 2015 and as at the supreme court cannot be appealed without a change of law

    Hi All,

    Just an update on the above, have received a letter from the parking company, who have advised that the charge has been quashed, and no further action will be taken in the matter, also offered their apologies for any inconvenience caused.

    A big thank you to all who offered their comments, particularly Storck, post number 10 dated 25 November, I sent my letter based on his suggestion on the link, and the reply from the parking company was identical to the one I got.

    alternatively the landowners should tighten their processes so they are fully compliant with the law.
