    I’m guessing they will have taken numerous legal advices and will probably have a rule somewhere to allow for expulsion mid season without an egm

    Yep because that is the debt that Bury have to them. That bit is the correct process but not notifying that they are connected to Dale is very naughty, even more so if Dale gave him the cash

    It was that £7.1 million 'debt' that got the CVA through for Dale.

    Dale has plenty of form for this. All the time he claimed all he wanted was the best for Bury football when in truth he was carrying out his plan to rinse the club of every last penny he could get. Despicable human being.

    MPs talk some rubbish. The club wasn’t capable of showing they could finish the season and no one bought them in the allocated time.

    I think the MPs are saying the EFL/FA should have had regulations in place that prevented Bury getting into the position they did, rather than suggesting the club, under Steve Dale, should have been allowed to stay in the League.

    I agree that there should be reguations in place but imagine the up roar if we were pushing for promotion at Christmas this year and the EFL/FA say to us we can not sign anyone and have to send some players out because we are 'over' spent. We would go mental at them and more so if we didn't then get promotion.

    Yes I think that's exactly what they're saying. It's a bit ironic therefore to criticise the EFL when they've finally applied the the regulations and kicked Bury out.

    As you well know, the EFL does have rules for controlling playing costs, known as as SCMP. They are far from perfect and as I've said before, need to be strengthened imo. One of the purposes of SCMP is to bring some discipline into lower league club's fiances and to prevent them living beyond their means. A club which wants to push the boat out and go for promotion without the finance in place to do that is heading for trouble.

    One of the key aspects of SCMP is that during the season if an owner or director expects to breach the SCMP cap during the remainder of the season, the club has to notify the EFL. But that is entirely dependent on the honesty of the director in telling the EFL. As with Bury, the real position didn't come to light until after the end of the season and the club's accounts had been provided to the EFL. In my world, I'd expect the EFL rules to be tightened and to take action against an individual director (and not just the club) who fails to inform the EFL in the way it's supposed to happen.

    Again that wouldn't stop the problem but stick a plaster over the issue after, the club could still be left in dire straights

    It would depend how the individual director was sanctioned. Directors who choose to ignore the SCMP rules now might well think twice in the future especially if the sanction meant that they would then fail the Owners & Directors test.

    They only have to take the test when buying a club. If they already own it then it isn't applied

    I already know that. It would require further changes to the O&D test to make it work properly.

    I'll stop here because it's beginning to feel like drawing teeth.
